1. Scope and Acceptance

1.1 These Terms and Conditions (the "Terms") apply to your application and registration for the Hotcoin Card, the issuance and activation of the Hotcoin Card, your possession or use of the Hotcoin Card, any related account, and any related services (collectively, the "Services").
1.2 By checking the box indicating your acceptance on the application page, submitting an application, having the Card issued to you, activating or using the Card, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to these Terms, as well as the User Agreement, Privacy Policy, Risk Disclosure, fee schedules, campaign rules, and any other rules displayed on the relevant pages that apply to your Hotcoin account.
1.3 If these Terms conflict with any specific terms applicable to a particular Service, the more recent and expressly applicable specific terms will prevail with respect to that Service. Nothing in these Terms excludes or limits any mandatory rights available to you under applicable law.
1.4 These Terms do not modify any rules of a card issuer, payment institution, card network, acquirer, or other Service Provider that are directly applicable under applicable law. Rules relating to Card Transactions, payment networks, or third-party services will prevail with respect to the matters they govern.

2. Definitions

Unless the context otherwise requires:
  • Hotcoin Card ("Card"): A payment card issued by the relevant card issuer and made available through Hotcoin and the relevant Service Providers.

  • Card Account: The account or account record associated with the Card that records balances, fees, transactions, refunds, adjustments, and other related matters.

  • Cardholder or you: A verified user who applies for and is approved to use the Services.

  • Service Provider: A card issuer, payment institution, card network, processor, or other third party that supports card issuance, account services, transaction processing, clearing, identity verification, compliance, dispute handling, or other Services.

  • Available Balance: The balance currently available for relevant transactions or permitted account operations, excluding amounts subject to authorization holds, clearing, refunds, disputes, freezes, Negative Balances, or other restrictions.

  • Card Transaction: Any authorization, purchase, reversal, refund, adjustment, fee, dispute, chargeback, or other transaction involving the Card.

  • Authorization: The stage at which, following submission of a transaction by a merchant or other transaction initiator, a Service Provider provisionally approves the transaction or temporarily places a hold on the relevant amount.

  • Clearing: The stage at which a Service Provider or payment network determines the final transaction amount, applicable fees, and settlement outcome.

  • Negative Balance: An amount owed where the Card Account balance falls below zero as a result of transactions, fees, refunds, disputes, compulsory debits, adjustments, or other circumstances.

3. Eligibility, Registration, and Identity Information

3.1 You must meet the minimum age required by applicable law, have the legal capacity to enter into a binding contract, and reside in a jurisdiction where the Services are available. Eligibility is subject to the requirements displayed on the application page, Service Provider requirements, risk assessment results, and applicable law.
3.2 You must maintain a Hotcoin account in good standing and complete any identity verification, know-your-customer ("KYC"), anti-money laundering ("AML"), counter-terrorist financing ("CTF"), sanctions screening, anti-fraud, and other risk assessments required by Hotcoin, a Service Provider, or an authorized third party.
3.3 You represent and warrant that your name, date of birth, nationality, residential address, contact information, identification documents, and all other information you provide are true, accurate, complete, valid, and kept up to date. If any information is expired, inaccurate, inconsistent, incomplete, or cannot be verified, Hotcoin may request additional information, suspend your application, restrict the Services, or terminate the Services.
3.4 You must not use multiple accounts, another person's identity, false information, or any other means to circumvent restrictions on the number of Cards, geographic restrictions, applicable limits, risk controls, fees, or compliance requirements. The Card, Card Account, and Services may not be sold, rented, transferred, lent, or made available for use by any unauthorized third party.

4. Nature of the Card and Account

4.1 The type of Hotcoin Card, account type, available features, supported jurisdictions, transaction channels, and scope of Services are subject to the disclosures on the application page, Service pages, and any applicable specific terms. Submission of an application does not guarantee approval, issuance, or continued availability of the Services.
4.2 Unless expressly stated otherwise on the relevant page or under applicable law, the Card Account does not constitute a bank deposit account, credit card facility, loan, or other financial product, and does not provide or guarantee interest, returns, principal protection, or credit.
4.3 Account balances, transaction amounts, fees, refunds, adjustments, and other account records are subject to the final records of Hotcoin and the relevant Service Providers. Displayed, estimated, or pending amounts do not constitute final settlement amounts.
4.4 Hotcoin may impose, adjust, or modify limits or restrictions relating to the number of Cards, transaction amounts, transaction frequency, merchant categories, jurisdictions, or Service features based on applicable law, regulatory requirements, risk considerations, liquidity, Service Provider requirements, system conditions, or operational needs.

5. Issuance, Activation, and Changes to the Services

5.1 You must follow the instructions provided on the relevant pages to complete the application, submit required information, complete identity verification and risk reviews, and satisfy any other required steps. A Service Provider may independently determine whether to approve an application, issue the Card, or continue providing the Card and related Services.
5.2 The final status provided by Hotcoin, the relevant Service Provider, or payment network will determine whether a Card has been issued, activated, frozen, unfrozen, closed, reissued, or otherwise subject to a status change. A status of "applying," "processing," or "under review" does not mean that the Card has been issued.
5.3 Hotcoin may add, suspend, replace, or discontinue Service features based on Service Provider capabilities, applicable law, risk considerations, or operational conditions, subject to any notice required by applicable law.

6. Funds, Transfers, and Account Operations

6.1 You may transfer funds into or out of, or otherwise use funds in, the relevant account only through methods expressly supported by Hotcoin or specified on the relevant Service page. Supported assets, channels, limits, frequency, fees, processing times, and restrictions are subject to the relevant page and any applicable specific terms.
6.2 Amounts may be temporarily unavailable while an Authorization, Clearing, refund, dispute, freeze, risk review, system process, or other processing activity is pending. You must not repeatedly submit the same request while it remains pending.
6.3 If a request fails, is cancelled or reversed, or its status is corrected, Hotcoin will restore, release, or adjust the relevant account records based on the final status. Until a third party provides a final result, the status displayed on the relevant page does not constitute confirmation that a transaction has finally succeeded or failed.
6.4 Hotcoin may require additional verification, delay or reject a request, or refer it for manual review based on account status, login status, risk considerations, AML requirements, sanctions, unusual activity, technical reasons, or legal requirements.
6.5 No operation involving funds constitutes a guarantee by Hotcoin of any particular processing or receipt time, exchange price, asset value, or successful completion of a transaction.

7. Fees and Taxes

7.1 Service fees, transaction fees, account fees, third-party fees, network fees, foreign exchange spreads, dispute fees, and any other applicable charges will be as disclosed on the Service page, fee page, transaction confirmation page, or in any applicable specific terms.
7.2 Service Providers, card networks, merchants, acquirers, or other third parties may impose separate fees. Except for fees expressly charged by Hotcoin, Hotcoin does not control third-party charges and does not guarantee that an amount displayed by a merchant will be the same as the final settlement amount.
7.3 Transaction amounts, fees, exchange rates, and other amounts may change following final Clearing, a refund, reversal, adjustment, or additional processing by a third party. You agree to pay all amounts lawfully and contractually due according to the final valid records.
7.4 You are responsible for any taxes, filings, accounting requirements, or other legal obligations arising from your use of the Services, unless applicable law provides otherwise or Hotcoin expressly assumes such responsibility.
7.5 If any fee or the party responsible for paying any fee changes, Hotcoin will provide notice in accordance with Section 19. If applicable law requires earlier or more specific disclosure, the requirements of applicable law will prevail.

8. Card Use and Prohibited Uses

8.1 You may use the Hotcoin Card only where supported by the relevant Service Providers, card networks, and merchant networks. Merchant acceptance, geographic availability, whether additional verification is required, and whether the transaction is ultimately authorized may be determined by the merchant, acquirer, card network, card issuer, or applicable risk systems.
8.2 You must not use, or permit any other person to use, the Hotcoin Card for:
  • any activity that violates applicable law, sanctions, AML, CTF, or regulatory requirements;

  • fraud, unauthorized use, money laundering, cash-out schemes, sham transactions, arbitrage, circumvention of restrictions, or other abusive activity;

  • transactions involving sanctioned persons, entities, jurisdictions, or restricted merchant categories;

  • cash or quasi-cash transactions, gambling, illegal goods or services, unauthorized financial activities, or other transactions prohibited by a Service Provider, card network, or Hotcoin;

  • resale, rental, acting as a nominee holder for or making payments on behalf of another person, sharing the Card among multiple users, or any activity that may compromise the security of the Card program, payment network, merchants, or systems.

8.3 Hotcoin, a Service Provider, card network, or merchant may reject, delay, reverse, freeze, or restrict a transaction for compliance, fraud, security, limit, technical, network, merchant category, geographic, balance, or other risk-related reasons. Hotcoin may not disclose all risk-control rules or the reasons for a third-party rejection.
8.4 You must not use transaction splitting, repeated authorizations, dynamic currency conversion, or any other method to circumvent fees, limits, geographic restrictions, or risk controls. You must carry out card transactions personally.

9. Authorization, Clearing, and Transaction Details

9.1 Card Transactions generally undergo Authorization before being cleared by the relevant Service Provider or payment network. Successful authorization means only that the transaction has been provisionally approved at that time. It does not guarantee successful final clearing, an unchanged transaction amount, or the absence of subsequent adjustments.
9.2 During Authorization, Hotcoin or a Service Provider may temporarily place a hold on balances, fees, or risk reserves associated with the transaction. Once clearing is completed, or following transaction failure, reversal, refund, or other final processing, the relevant hold may be released, adjusted, or converted into a final debit.
9.3 Authorization amounts, final clearing amounts, transaction currencies, fees, exchange rates, and other transaction information may subsequently be updated. The same transaction may initially appear as pending and later be updated to completed, failed, reversed, refunded, or another final status.
9.4 Refunds, supplemental fee entries, settlement adjustments, compulsory debits, disputes, or other related matters may appear as separate records. A related record does not necessarily indicate a duplicate charge. You should review the original transaction, related records, and final account movements together.
9.5 Hotcoin will make transaction details available through the App, Web, or another designated interface. You should promptly review transaction dates and times, merchant information, Card details, amounts, fees, refunds, and related records.

10. Card Security, Loss, and Unauthorized Transactions

10.1 You must safeguard your Hotcoin account, login credentials, authentication tools, devices, card number, expiration date, verification codes, and other security credentials. You must not disclose, share, rent, or permit any other person to use them.
10.2 If your Card, account, device, or security credentials are lost, stolen, compromised, disclosed, or taken over, or if you identify any unauthorized, suspicious, erroneous, or duplicate transaction, you must immediately report it through Hotcoin's official customer support channels or the Card freeze option provided on the relevant page.
10.3 Hotcoin may initially freeze an individual card, all cards, the relevant account, or the Services to protect funds, manage risk, or investigate transactions. You must provide transaction information, device information, login records, merchant information, communications, and any other information reasonably required for an investigation, and must not delete, alter, or fabricate evidence.
10.4 Liability for, and any refund or compensation relating to, an unauthorized transaction will be determined based on applicable law, card network rules, the results of the Service Provider's investigation, your confidentiality obligations, and whether there has been any intentional misconduct or gross negligence on your part.
10.5 Delayed reporting, voluntary disclosure of security credentials, circumvention of security measures, use of a compromised device, or failure to protect your account in accordance with Hotcoin's instructions may affect the outcome of an investigation, dispute, or recovery of funds.

11. Refunds, Reversals, Disputes, and Chargebacks

11.1 For disputes relating to goods, service quality, delivery, or merchant performance, you should first contact the merchant and retain supporting evidence. A merchant's agreement to issue a refund does not mean that the refund has been credited to the relevant account. Refunds remain subject to processing by the merchant, acquirer, card network, Service Provider, and applicable systems.
11.2 If the merchant is unable to resolve the matter, you should contact Hotcoin Customer Support as soon as possible and provide the original transaction details, evidence of any refund or reversal, the reason for the dispute, and any other reasonably required information. Hotcoin will assist in submitting or forwarding the dispute to the extent permitted by the relevant Service Provider and applicable card network rules.
11.3 A refund or reversal may appear as a new record linked to the original transaction. Refund timing, final amounts, dispute eligibility, and outcomes are subject to the merchant, card network, Service Provider, transaction category, and applicable time limits. Cash or quasi-cash transactions, transactions that violate applicable rules, or transactions for which required information is missing may not be eligible for a refund or chargeback.
11.4 Until the final outcome of a dispute, refund, or chargeback is determined, Hotcoin may retain necessary amounts, restrict transfers out, or suspend the relevant Services.

12. Negative Balances and Account Restoration

12.1 If transactions, fees, refunds, disputes, compulsory debits, adjustments, or other matters cause the relevant account balance to fall below zero, you must promptly cover the Negative Balance after receiving notice. A Negative Balance does not cease to exist because the Card is frozen or closed or because you stop using the Services.
12.2 While a Negative Balance remains outstanding, Hotcoin may suspend all or part of the functionality of the relevant account and associated cards. Subsequent deposits or other account entitlements lawfully available for such purpose may be applied first toward covering the Negative Balance.
12.3 Subject to applicable law, the User Agreement, and the actual account relationship, Hotcoin may settle, set off, or retain account entitlements that may lawfully be used for such purpose. Any other recovery measures will be carried out in accordance with applicable law and the policies of the entity ultimately providing the Services.
12.4 Hotcoin will not eliminate a Negative Balance or accounting discrepancy by modifying or deleting the original transaction. Hotcoin will retain records of the original transaction, subsequent adjustments, Negative Balance, repayment, and restoration.

13. Suspension, Restriction, and Termination

13.1 Hotcoin, a Service Provider, card issuer, or card network may suspend, freeze, restrict, reject, or terminate all or part of the Services in any of the following circumstances. Whether prior notice is provided will depend on applicable law and security requirements:
  • suspected fraud, unauthorized use, account takeover, unusual transactions, or other security risks;

  • breach of these Terms, the User Agreement, Privacy Policy, campaign rules, or Service Provider rules;

  • failure to complete, inability to pass, or a requirement to repeat identity verification, AML checks, or sanctions screening;

  • requirements imposed by regulators, courts, sanctions authorities, law enforcement agencies, card networks, or payment networks;

  • a Negative Balance, insufficient funding coverage, reconciliation discrepancies, system failures, or interruption of third-party services;

  • exceeding applicable limits, repeated submissions, circumvention of risk controls, unauthorized use, or other conduct that may adversely affect the Services.

13.2 You may request to discontinue or close the Services in accordance with the procedures then made available by Hotcoin. A closure request does not affect any transactions, fees, refunds, disputes, Negative Balances, taxes, or other amounts payable that arose before closure.
13.3 Following suspension or termination, you must stop using the affected Cards and Services. Hotcoin may retain necessary account balances, transaction records, or restrictions for a reasonable period to process unsettled authorizations, refunds, disputes, chargebacks, fees, Negative Balances, legal obligations, or investigations.
13.4 Termination of the Services does not delete or alter historical transaction, identity verification, audit, dispute, or accounting records. Records will be retained in accordance with the Privacy Policy, applicable law, and compliance requirements.

14. AML, Sanctions, and Compliance Cooperation

14.1 You agree to promptly provide any information, declarations, source of funds, source of wealth, or other supporting information and assistance reasonably requested by Hotcoin, a Service Provider, or an authorized third party for customer identification, AML, CTF, sanctions screening, anti-fraud, tax, regulatory reporting, investigation, and risk management purposes. 
14.2 Transactions or Services may be blocked, frozen, delayed, reversed, rejected, or made subject to requests for additional information. Hotcoin may not disclose specific monitoring rules, trigger reasons, or investigation information where permitted or required by applicable law. If you fail to provide requested information or the information cannot be verified, Hotcoin may restrict or terminate the Services.
14.3 You must not use the Services to split transactions, receive or make payments on behalf of others, conceal beneficial owners, or circumvent geographic restrictions, sanctions, limits, or regulatory obligations. You are responsible for legal, tax, and other liabilities arising from unlawful conduct, false information, or improper use of the Services.

15. Digital Asset and Payment Risk Disclosure

You acknowledge and understand that:
  • Digital assets may be subject to market, liquidity, issuer, blockchain, regulatory, technological, and price volatility risks.

  • Authorization, clearing, refunds, exchange rates, fees, and transaction outcomes may be determined at different times, and the final debit or Available Balance may differ from the estimate shown when a transaction is initiated.

  • Merchants, acquirers, card networks, card issuers, payment networks, internet services, devices, third-party services, or Hotcoin systems may become unavailable, experience delays, or encounter errors.

  • The Services do not constitute investment advice, a promise of returns, a guarantee of principal, or any form of investment management.

  • You must ensure that any goods or services paid for using the Services comply with applicable local law, and you are responsible for any applicable tax, reporting, and accounting obligations.

16. Personal Data, Transaction Data, and Third-Party Services

16.1 For the purposes of providing and maintaining the Services, auditing, risk management, identity verification, compliance, payment processing, clearing, dispute resolution, customer support, and regulatory reporting, Hotcoin may share necessary identity, contact, device, transaction, Card, and account information with Service Providers, card issuers, payment institutions, card networks, identity verification providers, compliance providers, customer support providers, and other contracted service providers.
16.2 Relevant information may be processed, stored, or transferred outside the jurisdiction in which you are located. The specific purposes and scope of processing, retention periods, cross-border transfer mechanisms, user rights, and categories of recipients or processors are subject to the Hotcoin Privacy Policy, applicable Service Provider privacy notices, and applicable law.
16.3 If Hotcoin provides or integrates mobile payment services, digital wallets, or other third-party services, you must also comply with the applicable third party's terms and privacy policy. The availability, security, functionality, and performance of third-party services are the responsibility of the relevant third-party provider.

17. Service Availability and Third-Party Dependencies

17.1 Hotcoin does not guarantee that the Services, Card functionality, merchant acceptance, Authorization, Clearing, refunds, dispute processing, or account inquiries will be available at all times, nor does Hotcoin guarantee that any transaction will be accepted by a merchant, card network, card issuer, or payment network.
17.2 To the extent permitted by applicable law, Hotcoin will not be liable beyond what is required by law for delays, interruptions, or failures beyond its reasonable control, including network or system failures, telecommunications outages, malicious attacks, natural disasters, war, strikes, government or regulatory action, third-party service failures, actions of merchants or acquirers, or payment network congestion.
17.3 Unavailability or delay does not mean that a transaction has automatically failed. You should rely on transaction details, account records, customer support information, and final account movements, and must not resubmit a request merely because a page has not yet been updated.

18. Limitation of Liability

18.1 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability arising from fraud, willful misconduct, gross negligence, or applicable consumer protection laws.
18.2 Hotcoin will not be liable beyond what is required by applicable law for losses arising from merchants, card networks, card issuers, payment institutions, identity verification providers, devices, networks, exchange rates, digital asset prices, indirect losses, loss of profits, loss of goodwill, or your breach of these Terms.
18.3 This Section does not affect Hotcoin's obligation to correct verifiable discrepancies caused by its own systems in accordance with confirmed accounting records and applicable refund, dispute, or error-resolution procedures, nor does it affect any rights you may have under applicable law in relation to complaints, refunds, protections against unauthorized transactions, or any other mandatory rights.

19. Changes to These Terms and Notices

19.1 Hotcoin may amend these Terms due to changes in products, Service Providers, card network requirements, applicable law, regulation, risk, fees, or security considerations. Hotcoin may notify amendments through the App, Web, email, in-app messages, push notifications, or other lawful channels.
19.2 Amendments that materially affect user rights, fees, liabilities, or the scope of the Services will be notified within a reasonable period before taking effect where required by applicable law. Urgent changes relating to security, sanctions, fraud, or regulatory requirements may take effect immediately, with supplementary notice provided where permitted by law.
19.3 Your continued use of the Services after an amendment takes effect will constitute acceptance only to the extent permitted by applicable law and where valid notice has been provided. If you do not agree to a material amendment, you should stop using the Services and request account closure through the available procedures. Transactions, fees, refunds, disputes, and Negative Balances arising prior to closure will remain subject to the terms applicable at the time they arose.

20. Governing Law, Complaints, and Dispute Resolution

20.1 The final published version of these Terms will specify the entity providing the Services, the card issuer, the governing law, the courts of competent jurisdiction or applicable arbitration body, complaint channels, and any available external redress mechanisms, subject to any mandatory consumer protection requirements applicable in the user's jurisdiction.
20.2 You may submit complaints concerning applications, transactions, fees, refunds, unauthorized transactions, account restrictions, data processing, or other aspects of the Services through the Hotcoin App, Web, or the official customer support and complaint channels specified in the final published version.
20.3 During any formal complaint or dispute resolution process, you must provide true, complete, and relevant information and cooperate with any reasonable investigation. Communications with customer support do not replace any formal complaint, arbitration, litigation, or external redress procedure provided by law.

21. Severability, Assignment, and Entire Agreement

21.1 If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the validity and enforceability of the remaining provisions will not be affected. To the extent permitted by law, the affected provision will be replaced by a valid and enforceable provision that most closely reflects its original purpose while minimizing any impact on the user's lawful rights.
21.2 You may not assign or transfer your rights under these Terms, your account, or your Card. Hotcoin may assign, transfer, or delegate relevant rights and obligations in connection with a Service migration, change of contracting entity, change of Service Provider, or other circumstances permitted by law, subject to any notice required under applicable law.
21.3 These Terms, together with the User Agreement, Privacy Policy, Risk Disclosure, fee pages, campaign rules, and application pages, constitute the rules governing the Services. Any specific terms will prevail over these Terms only to the extent that they expressly apply.
